Terms of Use
Acceptance
These Terms of Use (“Terms”) govern your access to and use of elorafunding.com, its subpages and any content, forms or features on it (together, the “Site”). By using the Site or submitting the loan-request form, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
Who we are
The Site is operated by Elora Solutions LLC, a Wyoming limited liability company doing business as Elora Funding. Our mailing address is 8221 Crespi Blvd, Miami Beach, FL 33141. Our registered agent for service of process is Northwest Registered Agent LLC, 30 N Gould St Ste N, Sheridan, WY 82801.
Eligibility & business-purpose certification
The Site is intended solely for real estate investors, entrepreneurs and business owners seeking business-purpose financing secured by non-owner-occupied real estate or by a business asset. You are eligible to submit the form only if all of the following are true:
- You are at least 18 years old and have the legal capacity to enter into a contract.
- You are located in one of the states where we currently operate. See “States where we operate” below.
- The financing you are requesting is for a business purpose under 12 C.F.R. § 1026.3(a) — that is, the proceeds will be used primarily for business, commercial, agricultural or investment purposes and not primarily for personal, family or household purposes.
- The collateral is non-owner-occupied investment or commercial real estate, or a commercial asset. It is not a primary residence.
- You have authority to submit the request and to provide the phone number and email address on the form — either because they are yours or because you have the account-holder’s prior express consent to submit them.
By submitting the form, you certify that each of the statements above is true.
Nature of the service
Elora is not a lender. We do not underwrite, approve, deny or fund loans. We do not make credit decisions. We do not set interest rates, fees or terms.
Elora is a marketing and referral service. When you submit the form, we may share your information with one or more Marketing Partners — independent third-party lenders, brokers and capital providers — that may reach out to quote your deal. Any resulting quote, application, disclosure, contract, loan or funding is between you and that Marketing Partner and is subject to their underwriting, licensing, credit criteria, appraisal, title work and final approval. Timelines and terms are theirs, not ours.
The current Marketing Partners list is published at /partners/ and is updated as partners are added or removed.
The Site is not an application for credit, is not an offer to lend and is not a commitment to lend. No creditor-customer relationship, fiduciary relationship or attorney-client relationship is created by using the Site.
States where we operate
The Site is intended for use only by people located in the United States, in states where we currently accept inquiries. Elora Funding does not accept inquiries from, and does not market, refer, arrange or transmit loans in, the following jurisdictions: Arizona, California, Idaho, Nevada, North Dakota, Oregon, South Dakota or Vermont. If you are located in one of those states, do not submit the form and do not use the Site.
Availability of specific loan products depends on the Marketing Partner and their state licensing footprint. Not all products described on the Site are available in all states.
Your responsibilities
- Provide accurate, current and complete information. Do not submit another person’s information without their permission.
- Do not submit the form on behalf of a consumer for a consumer-purpose loan, or with the intent to circumvent the business-purpose scope of the Site.
- Do not submit through automated means, scrapers, bots, purchased lists, incentivized traffic or any other method that would make consent unreliable.
- Do not use the Site in any way that violates law, infringes the rights of others or interferes with the Site’s operation.
Claims & illustrative figures
Statements on the Site about loan amounts, leverage (LTV / LTC / DSCR), closing timelines, turnaround times and program features describe illustrative program maximums or best-case scenarios offered by our Marketing Partners for well-qualified files. They are not guaranteed and they are not offers of credit. Actual figures depend on the borrower profile, sponsor experience, property, market, appraisal, title, credit and current lender pricing, and are set by the Marketing Partner, not by Elora.
Where the Site refers to closing in as little as 14 days, it means the shortest close a Marketing Partner has quoted for a comparable, clean file with clear title and no diligence issues. Median timelines are longer. Where the Site refers to receiving terms in 24 hours, it means the initial response window we target for complete inquiries submitted during business hours; incomplete inquiries or inquiries requiring lender scenario work take longer.
Where the Site refers to an instant or instantly matched program — including the “instant program match” shown after the first step of the request form — it means only that the Site immediately identifies which financing program category your stated loan purpose corresponds to. That match is informational routing. It is not an offer of credit, an application decision, an approval, a pre-approval, a rate, or a quote of terms, it is not based on any review of your credit or financial condition, and it does not indicate that you or your property will qualify. Rates, terms, sizing and eligibility are determined solely by third-party lending partners after they review a complete file, and are communicated in the specialist call described above.
Marketing Partners & third-party sites
Elora does not control Marketing Partners or third-party websites. We are not responsible for their products, disclosures, privacy practices, security or the content of their sites. When you submit information to a Marketing Partner or leave the Site to visit theirs, their terms and privacy policy govern that relationship.
Intellectual property
The Site, its text, graphics, logos, code and design are owned by Elora Solutions LLC or its licensors and are protected by copyright, trademark and other intellectual-property laws. You may not copy, reproduce, distribute, modify, publicly display, transmit or exploit the Site or any portion of it, except as expressly permitted here.
Privacy
Our Privacy Policy is incorporated into these Terms by reference and describes how we collect, use, share and protect your personal information. If you are a California resident, please also review our Do Not Sell or Share My Personal Information page.
Disclaimers
The Site is provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, Elora disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy and quiet enjoyment.
Nothing on the Site constitutes legal, tax, financial or investment advice. Consult your own advisors before making financing or investment decisions.
Limitation of liability
To the fullest extent permitted by law, Elora will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenues, business, data or goodwill, arising out of or relating to your use of the Site, even if we have been advised of the possibility of those damages. Elora’s total liability arising out of or relating to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations, and in those jurisdictions our liability is limited to the smallest extent permitted by law.
Indemnification
You agree to defend, indemnify and hold harmless Elora Solutions LLC, its officers, employees, agents, service providers and Marketing Partners from any claim, demand, loss, liability, damage, expense or fee (including reasonable attorneys’ fees) arising out of or related to (a) your breach of these Terms, (b) your submission of another person’s contact information without authorization or (c) your violation of any law or the rights of a third party.
Binding arbitration & class-action waiver
You and Elora agree that any dispute, claim or controversy arising out of or relating to these Terms, the Site or your use of the Site will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or, for business claims, its Commercial Arbitration Rules). The arbitration will be seated in Wyoming or, at your election, in the federal judicial district where you reside. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. You and Elora agree that each of us may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in a class, consolidated or representative action. The arbitrator may not consolidate more than one person’s claims and may not preside over any class or representative proceeding.
30-day opt-out. You may opt out of this arbitration provision by emailing info@elorafunding.com with the subject line “Arbitration opt-out” within 30 days of first agreeing to these Terms. Include your name, mailing address and a statement that you decline arbitration. Opting out will not affect any other provision of these Terms.
Nothing in this section prevents either party from bringing an individual action in small-claims court, seeking injunctive relief in court to protect intellectual property, or filing a complaint with a government agency.
Governing law & venue
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. Subject to the arbitration provision above, exclusive venue for any court proceeding lies in the state or federal courts located in Wyoming, and you consent to personal jurisdiction there.
Changes
We may update these Terms from time to time. The version identifier and effective date at the top of the page will change when we do. Material changes will be posted here at least 10 days before they take effect. Your continued use of the Site after the effective date constitutes acceptance of the updated Terms.
